Biddle Consulting Group, Inc. (BCG) enlists a team of tenured experts specializing in Affirmative Action Plan development and audit support. BCG continuously supports (and closes) hundreds of OFCCP audits in every region of the country. Audit activity includes desk audits, on-site audits and Corporate Management Compliance Evaluations (CMCEs).
With the OFCCP's addition of testing and statistical experts, audits are now more reminiscent of class-action lawsuits than the simplified audits of the past. With the stakes so high, and the Department of Labor armed with their own experts, don't you think it's time to give BCG a call?
OFCCP Audit Support – Biddle Consulting Group's tenured consultants work directly with federal contractors to establish an audit support strategy focused on minimizing exposure.
- Recordkeeping – Federal contractor's greatest compliance challenge is adequate recordkeeping. Unfortunately, OFCCP is well aware of this fact and the result is a dramatic increase in financial remedies collected by OFCCP. In fact, the OFCCP has posted on their web page that financial remedies have increased by 133% since 2001. As part of AAP development as well as audit support, BCG will perform detailed data analyses to seek out legitimate options that will reduce client exposure to the OFCCP as well as minimize and often eliminate problem areas.
- Adverse Impact – By leveraging years of experience in EEO Litigation, BCG is uniquely qualified to help your organization identify and mitigate problem areas associated with hiring, promotional, and termination decisions. BCG's consultants provide the needed expertise to analyze complex organizational processes with the appropriate statistical analyses.
- Test Validation – If adverse impact is identified in a particular practice, procedure, or test (including interviews), an employer is required to show that the test is job-related for the position in question and consistent with business necessity . . . in other words, that it's valid. BCG's consultants have developed hundreds of valid tests and have worked with employers to defend tests that have come under scrutiny by enforcement agencies.
- Compensation Analyses – Advanced compensation (regression or other) analyses may seem new to many contractors, but they are nothing new to BCG. We have been using statistics and regression in EEO litigation to explain compensation disparities for over 30 years. With the OFCCP's own statistical experts paying close attention to compensation during even the most routine audits, it should be a requirement that contractors proactively analyze compensation data prior to submitting it to the OFCCP. BCG is prepared to mimic the OFCCP's compensation analysis approach and work with contractors to proactively and conclusively investigate disparities.
- Corporate Management Compliance Evaluation (CMCE)/Glass Ceiling Audit – Typically a CMCE focuses on contractors' management personnel in order to identify systemic disparities in promotional and compensation practices. As a result, a CMCE can include considerable back-pay and interest for employers who are unable to justify significant differences in compensation or promotion rates. With a lengthy history in supporting CMCEs and EEO litigation cases, BCG can properly investigate compensation and promotional decisions to identify the true cause of disparities.
